We deal with a natural product and occasionally a specific flower type may be unavailable on the day. If this occurs, we reserve the right to substitute one flower type for another. We will endeavour to retain the ordered style of arrangement, and the flowers used will be to the same or higher value.

 

GENERAL

 

1. These terms and conditions shall be governed by and construed in accordance with English law and the parties agree to submit to the exclusive jurisdiction of the English courts.

2. Pinstripes and Peonies reserve the right to amend or waive these terms for specific events. Any such amendment or waiver will be notified to the Client in writing.

3. No alteration to these terms will be valid unless approved in writing by Pinstripes and Peonies.

 

EVENT CONFIRMATION

 

1. Pinstripes and Peonies require the Client to sign and return this confirmation form to confirm the booking. This written confirmation constitutes acceptance of Pinstripes and Peonies terms and conditions and the latest anticipated quote.

2. Pinstripes and Peonies reserve the right to revise and resend the anticipated quote in the event of a change in the number of items required or services needed.

 

NUMBERS

 

1. Pinstripes and Peonies require confirmed numbers 14 days before the event. Pinstripes and Peonies will endeavour to accommodate any change made after this time but regret that no allowance can be made if numbers are reduced within 14 days of the date of the event.

 

PAYMENT

 

1. All prices quoted are exclusive of VAT at the standard prevailing rate, unless otherwise stated.

2. On confirmation of an event, an invoice for 100% of the expected final bill will be submitted to the Client and is due on receipt. 3. Monies paid on confirmation will be deducted from the final invoice.

4. If full payment is not received prior to the event, Pinstripes and Peonies reserve the right to terminate this Agreement without further notice.

5. If Pinstripes and Peonies waive the terms relating to payment of deposits before an event, this shall not prejudice the rights of Pinstripes and Peonies to recover payment of the amounts that would otherwise be payable by the Client under these terms and conditions in the event of a cancellation or amendment of the event

6. Pinstripes and Peonies accept payment by BACS and credit card only. Credit card and AMEX payments will incur a 5% card payment fee.

7. Pinstripes and Peonies reserve the right to refuse credit terms to Clients

8. Pinstripes and Peonies do not store credit card details or share customer details with any third parties.

 

CANCELLATION

 

1. Once an event has been confirmed, Pinstripe and Peonies order flowers, reserve staff and sundries, and may refuse to supply other events on or around that time. Therefore, charges are payable for cancellation of a confirmed event.

2. Cancellations must be made in writing. The date of receipt of the cancellation notice will determine the cancellation charge applicable.

3. Pinstripes and Peonies reserves the right to charge the following of the most recent quoted amount for cancelled events:

14 days or less prior to the event: 100%

15 – 28 days prior to the event: 50%

28 Days or more prior to the event: 25%

 

BREAKAGES & LOSSES

1. Unless otherwise stated all vases, props, lanterns and candles remain the property of Pinstripes and Peonies. Losses and breakages will be charged for at the replacement cost.

2. Pinstripes and Peonies do not accept responsibility for the Client’s property and items are left with Pinstripes and Peonies at the owner’s risk.

 

LIABILITY

 

1. The liability of Pinstripes and Peonies, for a Supplier’s failure to perform or to provide services or otherwise, is limited to the value of that Supplier’s services.

2. Pinstripes and Peonies has no liability for any failure to provide and services due to industrial action, pandemic, postal or communications delay, plant failure, hostilities, acts of terrorism, the death of a Royal Family member or Head of State or any other circumstances beyond the control of Pinstripes and Peonies.

3. The Client shall indemnify and keep indemnified Pinstripes and Peonies against any costs or liabilities incurred by Pinstripes and Peonies as a result of any breach of these terms by the Client.

 

DATA MANAGEMENT

 

1. By signing the Confirmation Form, the Client agrees for Pinstripes and Peonies to retain their details and contact them in the future with further opportunities and marketing materials. The Client should let Pinstripes and Peonies know if they do not agree to be contacted in this way.
